1) Who we are

Marketers Quest is operated by MQAIS Technologies LLP ("we", "us", "our"), a registered business entity. These Terms apply to all users of marketers.quest and app.marketers.quest ("the platform").

2) Acceptance of terms

By accessing or using our website or platform, you agree to these Terms. If you do not agree, please do not use our services. If you are using the platform on behalf of a business, you confirm you have authority to bind that business to these Terms.

3) Our services

Marketers Quest provides:

• An AI-powered platform to discover trending content, generate creative directions, and plan brand content strategies.
• Marketing services including influencer campaign support, creator network onboarding, social strategy, and paid media.
• A creator network connecting brands with content creators.

We reserve the right to modify, suspend, or discontinue any part of the services at any time with reasonable notice where possible.

4) Accounts

To access the platform, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Keep your login credentials secure and confidential.
• Notify us immediately at contact@marketers.quest if you suspect unauthorised access.
• Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

5) Acceptable use

You agree to use our platform and services only for lawful purposes and in accordance with these Terms. You must not:

• Use the platform to violate any applicable law or regulation.
• Scrape, copy, or republish any data or content from the platform without our written permission.
• Attempt to gain unauthorised access to any part of the platform or its underlying infrastructure.
• Use the platform to transmit spam, malware, or harmful content.
• Impersonate any person or entity.
• Use AI-generated outputs to mislead, deceive, or harm others.
• Circumvent any technical measures we use to protect the platform.
• Resell or sublicense access to the platform without our prior written consent.

6) AI-generated content

Our platform uses artificial intelligence to generate trend recommendations, creative directions, content hooks, and execution blueprints. You acknowledge that:

• AI-generated content is provided for informational and creative planning purposes only.
• We do not guarantee the accuracy, completeness, or suitability of any AI output.
• You are solely responsible for reviewing, adapting, and approving any content before publishing or using it commercially.
• AI outputs do not constitute professional marketing, legal, or financial advice.
• The same or similar outputs may be generated for other users.

You retain ownership of any original inputs you provide. We do not claim ownership of content you create using our platform.

7) Meta & Instagram data

Our platform accesses Instagram trend data via Meta's Graph API under Meta's Platform Terms. By using trend-related features, you acknowledge that:

• Trend data (hashtag names, volume signals) is sourced from Instagram's public API and is subject to Meta's terms.
• You must not use trend data accessed through our platform in violation of Meta's Platform Terms.
• You must not attempt to extract, scrape, or store raw Instagram data from our platform beyond what is displayed for your own planning use.
• We are not affiliated with, endorsed by, or sponsored by Meta Platforms Inc.

8) Payments and subscriptions

Where paid plans are offered:

• All fees are stated at the time of purchase and are non-refundable unless required by law or stated otherwise.
• Subscriptions automatically renew unless cancelled before the renewal date.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Failed payments may result in suspension of access until resolved.

Specific pricing terms will be stated on the relevant plan or checkout page.

9) Intellectual property

All content, branding, software, and technology on the platform — including but not limited to the Marketers Quest name, logo, platform design, and underlying AI systems — is owned by or licensed to MQAIS Technologies LLP and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from any part of our platform without our express written permission.

10) Third-party services

Our platform integrates with third-party services including Meta (Instagram API), OpenAI, and Supabase. Your use of these integrations is also subject to the respective third parties' terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

11) Disclaimers

Our platform and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The platform will be uninterrupted, error-free, or free of viruses.
• Trend data will be current, complete, or accurate at all times.
• AI-generated content will meet your specific requirements or expectations.
• Results from using the platform will meet any particular business outcome.

12) Limitation of liability

To the fullest extent permitted by law, MQAIS Technologies LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform or services — including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid us in the 3 months preceding the claim, or £100, whichever is greater.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

13) Termination

You may stop using the platform at any time. You may delete your account via Settings or by emailing contact@marketers.quest.

We may suspend or terminate your access immediately if you breach these Terms, without refund of any fees paid. Upon termination, your right to use the platform ceases. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

14) Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice on the platform. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.

15) Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are accessing the platform from outside England and Wales, you agree that English law governs these Terms regardless of where you are located.
